X v. Bonta | Litigation | United States | Sep 8, 2023 | Preliminary Injunction Granted | Sep 4, 2024 |
Summary
X Corp., formerly known as Twitter, filed suit in the California Eastern District Court challenging the constitutionality of California AB 587. The social media company argued that requiring social media companies to disclose their content moderation and hate speech policies via a "Content Category Report" submitted to the state is a violation of the First Amendment.
Updates
December 28, 2023. The district court denied X's request for a preliminary injunction against the California state law.
July 18, 2024. The Ninth Circuit heard oral argument for X's appeal alongside the Netchoice v. Bonta suit. The panel was seemingly influenced by the Supreme Court ruling in Moody and Paxton, taking a more granular approach to platform transparency laws.
September 4, 2024. In a reversal of the district court's decision, the US Court of Appeals for the Ninth Circuit granted a preliminary injunction against the state law on First Amendment grounds. The panel argued that the Content Category Report provisions compel non-commercial speech and, therefore, are subject to strict scrutiny.
