Summary

Senator Maria Cantwell and Representative Cathy McMorris Rodgers unveiled draft legislation that would establish a national consumer data privacy standard. It aims to eliminate the “existing patchwork of state comprehensive data privacy laws” and establish robust enforcement mechanisms for violators, including a private right of action. It also sets standards for data minimization, gives consumers the right to opt-out, and requires covered entities to be transparent about how they use consumer data.
