Summary
Indiana State Attorney General Todd Rokita filed suit against TikTok and its parent company, ByteDance, over claims that TikTok deceives its users of the risks the Chinese government poses for accessing users' personal data and misled parents that the video-sharing app was appropriate for children. It was the first lawsuit to be filed against TikTok by a state attorney general, with a coalition of 14 attorneys general filing suit against the video-sharing app on October 11, 2024.
Updates
May 23, 2023. The US District Court for the Northern District of Indiana dismissed the case, claiming the state failed to prove that TikTok committed an unfair, abusive, or deceptive act in connection with a consumer transaction and that Indiana lacked jurisdiction to bring the suit. The opinion also states that "more than 90% of the complaint was devoted to irrelevant posturing" and any potential for Chinese espionage efforts via TikTok is irrelevant to Indiana's legal claim.
September 30, 2024. The Indiana Court of Appeals unanimously reversed the lower court’s decision to throw out the case, although ByteDance is dismissed as a party to the suit.
