Summary

The "SAFE for Kids Act" would prohibit social media companies from providing children under 18 with addictive feeds and ban overnight push notifications without parental consent if the feed is a “significant part” of the providers’ platform services. The bill defines an “addictive feed” as any online site or service that recommends, selects, or prioritizes what users see using an algorithm based on data collected from them. To limit access to these algorithmic feeds, the bill would use age verification to determine user age via “commercially reasonable methods.” The Act further grants the state attorney general with rulemaking authority and allows them to bring an action against a violative social media company within 3 months of the bill being passed. The bill is expected to go into effect on Sept. 9, 2024.
