Summary

AB-2013 is an act to add a section titled “Artificial Intelligence Training Data Transparency” to California’s Civil Code. This would require that starting January 1, 2026, all current and future generative AI (GenAI) systems or services that are made available to Californians must post on their website documentation regarding the data used to train the GenAI system or service. This documentation must include a high-level summary of the datasets used in development, including information such as:

  • Who owns the datasets, and how it was acquired by the developer
  • A description of the datasets and how they’re being used
  • Whether the datasets include copyrighted or personal information
  • If there were modifications made to the dataset by the developer

Developers will not have to post this documentation if the GenAI system is being used solely for security purposes, the operation of an aircraft in the national airspace, or was developed for national security, military, or defense purposes and is made available only to a federal entity.

August 27, 2024. Assembly concurs on Senate amendments by a vote of 75 to 0.

September 28, 2024. Approved by the Governor and chaptered by the Secretary of State (Chapter 817, Statutes of 2024).
